I came across this article here on Yahoo. The real problem is that after Californians approved this, they kept putting the Far Left Loons in charge of the government and those Far Left Loons kept increasing spending which worked ok during the boom years but when the boom ended and revenues started to drop they refused to cut spending. With California a day away from issuing IOUs instead of paying its bills, Gov. Schwarzenegger and the legislature remain at odds over how to close a now $26.3 billion deficit. Schwarzenegger on Thursday ordered a third unpaid furlough day for 235,000 state employees. With its $1.7 trillion economy sputtering and 11.5% unemployment surging, California's difficulty in balancing its budget could affect the national recovery. But the Golden State's budget problems are hardly new. The seeds of them were planted more than 30 years ago. They begin with the 1978 property tax revolt and the victory of Proposition 13. As California experienced a dramatic escalation in home values, property tax assessments skyrocketed. Especially vulnerable were seniors on fixed incomes. When then Gov. Jerry Brown and the legislature dithered, conservative activists led by Howard Jarvis put a seductively simple sounding proposition on the ballot. Under Proposition 13, the annual real estate tax on a parcel of property would be limited to 1% of its assessed value and this assessed value would only increase by a maximum of 2% per year, until a change in ownership. Voters responded and Proposition 13 scored a dramatic victory with 65% of the vote. Property tax rates dropped an average of 57%. While homeowners celebrated, city, county and school district officials sat in stunned disbelief. There were predictions of drastic cuts to education and social services. But the ax did not fall as Sacramento, flush with a multibillion-dollar surplus, bailed out local governments and the schools. But the state rescue was accompanied by a loss of local control. As a result of Proposition 13, school districts, county governments and cities were forced to compete with state priorities for a slice of the state budget. "In the first years after Proposition 13 passed, the state was able to get by because it had a surplus," says David Menefee-Libey, a political scientist at Pomona College. "But because the state is now responsible for funding local government and school districts the demands on state resources became too great. The second strategy followed by [Governors Gray] Davis and [Arnold] Schwarzenegger has been to finesse the fiscal crisis by using budget gimmicks and by borrowing to bridge the yearly budget shortfall. Now both options are exhausted." Proposition 13 has proved to be a two-sided sword. "One side was to protect the people from the government suddenly and wildly raising property taxes," says Bob Hertzberg, a former Assembly Speaker and co- chair of California Forward, a bipartisan reform group. "That was done. But we didn't resolve how to pay for the services that people want. So we have created this crazy government structure in Sacramento held together by duct tape and bailing wire. It's not coherent and needs to be changed." Proposition 13 further altered California politics by requiring a two-thirds majority for tax increases either at the state or local level. This requirement along with a constitutional provision requiring a two-thirds majority to pass a budget - the result of a proposition passed in 1933 - means it is far more difficult to raise taxes or pass a budget in California than in other states. For more than 30 years California has been living with a system of minority rule in which 34% of the legislature or a local community can stonewall the majority. Facing this post-Proposition 13 system, California's various interest groups have increasingly used the ballot box to protect themselves - but by so doing have mandated budgetary havoc. For example, pre-Proposition 13, California public schools were among the finest in the nation. After Proposition 13, education spending per pupil dropped to 48th in the nation. The state's educators and parents then rallied behind Proposition 98, which by a complex formula apportions roughly 40% of the state budget to K-14 education. In the past three decades, other special interests have authored - and voters have passed - numerous ballot measures dictating that millions in state funds go to various pet causes. Many of these measures, including a preschool initiative sponsored by Schwarzenegger in 2002, mandate a program but fail to provide a source of funding. Each proposal alone might have merit, but collectively these ballot measures have locked most of California's budget in place. "Gradually, the voters' piecemeal decisions have bound the legislature in a straightjacket," says Thad Kousser, a professor of political science at UC San Diego. Open Question: Need Professional Real Estate Law Help - NY (not NYC/Yonkers)?

Since I've had several responses, most out of State. I am looking for a Real Estate Professional, or Lawyer to help answer my question. I need someone from NY to assist me. The county involved is Monroe County. I am interested in a property that currently does NOT have a mortgage, its 100% paid for. My dilemma is that the house has back taxes on it. 2007 is currently held by a third party, and 2008 is delinquent and held by the county. I know the person will not be able to pay the taxes. I would like to know how to legally obtain the property, before it gets foreclosed, or seized by the town/county. The house is not for sale, and I don't know how to approach the situation. Open Question: I have interes in a house that owes back taxes, its not up for sale or foreclosed. How do I acquire it?

This is a Real Estate Legal Question - So if you are not licensed in Real Estate or Real Estate Law, please do NOT respond. Situation: I have an interest in a property, that was handed over to the individual, before the original owner had passed away. Currently she occupies the home. She does not maintain the home nor does she pay to have someone maintain it. The neighbor, out of what I believe is kindness, or they are fed up, mows the lawn for her. She is currently unemployed, and has personal issues, that I can not get into. She recieved the house as a "gift" in 2006. She has failed to pay any of the taxes on the property since 2006. Which I believe the Monroe County Social Services has something to do with a "mortgage" on the home, which the home itself has been paid off since it was new. Recently her son, whom she has no relationship with, paid 1 year worth of back taxes. I followed it and currently 2007 and 2008 taxes were sold to a third party company. Her son, neither her would be able to save the property. The reason why I am enlisted in Craigslist, is for some legal information. I've researched it slightly on how to approach it. I am very interested in the property, it has sentimental meaning for me as well. I need to now how I can legally obtain it, and save it from being foreclosed and probally torn down for new development. Structurally I believe the house is solid, but it needs a new roof, paint job, driveway, garage door, carpeting, bathrooms, basement needs to be worked on. Its not a complete move in ready home, either. Its property value probally has declined $40,000.00 in 3 years. Voting Question: Process of selling real estate property if it has a fraudulent loan?

A property owner hires a realtor to sell a condo. The realtor tells the owner that records show a deed of trust for a loan. The owner says he was not aware of this loan and it is definitely not his (it is fraudulent). 1.Is the realtor allowed to list the property anyway? 2.If the unresolved alleged/fraudulent deed of trust problem delays the close of escrow and therefore costs the seller money (seller paying mortgage + property taxes for an empty property and realtor says renting it out temporarily may violate the contract because the property should be empty 5 days before escrow closes) (and nobody knows how long before escrow closes), is the realtor not liable for any of these costs? Escrow is ready to close except for the fraudulent loan problem. Escrow offers to close escrow and hold the $ amount of the alleged/fraudulent loan for 8 days, or the title company will hold it for 30 days (or escrow offers 30 days and title company offers 8 days) while the seller and lender come to an agreement on whether the money is owed. The seller asks escrow what happens to the $ if that many days passes and there is no agreement. Escrow says the $ goes to the lender. Therefore, the seller refuses this option. Then the realtor, the broker, escrow, and the buyer’s agent all tell the seller that because the seller is refusing this option, the seller is holding up the close of escrow and therefore violating the contract. The seller’s realtor informs the seller that both realtor commissions are now due. The buyer’s agent files for mediation – seller does not know for what yet. After some time, seller ends up hiring a lawyer and alleged lender agrees to have $ in question placed in a separate account with the attorney. Escrow closes. 3.Does seller have less chance of getting her money back because the issue will be resolved after escrow closes? And if so, would the seller’s agent, the seller’s broker, and the escrow company have any liability for telling the seller she needs to close escrow before resolving the alleged/fraudulent loan problem? I am the seller. I was not aware the deed of trust (lien) existed before the realtor informed me. It is absolutely fraudulent. Then alleged lender is the loan officer I used in 2003 for 3 real estate purchases. He put the lien on the first property months it had already closed. At the time he put the lien on the property, I was in escrow with another property which I signed loan doc's for and was told I'd get copies of but never did because the price of the property changed during escrow and i had to sign all new doc's. It is absolutely fraudulent, and I feel like my only option is to sue the loan officer and hope to win. He is a very bright man and I'm pretty sure will have the whole story covered from beginning to end including any doc's needing my signature. Just a side note...I have asked him twice (for a copy of the front and back of the check that he says I cashed at his bank on a certain date. He has not responded to my emails... Is it possible that someone could pose as me and get away with forging and cashing a check for over $20 thousand dollars? If so, are there any other records I can get to help prove I never got that check? Thank you for your valuable feedback. Escrow has closed and the disputed funds have been set aside in a separate account. The alleged lender now has an address out of state. Wow. Ok my Father runs a business and he wants his profits / savings to be in safe hands so he wants to send me his savings every year which is around 35-40K US$ to my name/account here in Canada. I am lending my credit to a Someone to buy a house for her use, I will be paid $5,000 (hopefully) I am not at all familiar with the home buying process but I wanted to buy my own here in Miami taking adv of the situation and the $. 8000 tax credit put in place by the Obama ad. I am afraid I will lose more than I will win with this negotiation even if I am able to claim the $ 3,500 or so tax cr since I ll be a single person buying the house even though the house is $130,000. My friend is a real estate agent she insures me that She wil keep me on the title for 3 years so I comply with one of the coditions of the tax crdt and that she will not use any of the benefits available for first time buyers and this way I could use them afterwads she says that those benefits could be use for anybody even if already purchased a house before and who is not in title anymore. I don't know how much of this is true and even though I need the money badly I would not want to jeopardize my benefits along with peace of mind in the 30 years after I end up buying my own with maybe higher interest rates or riskier loans or anything related to this transaction kind of favor I am doing here. I am first time home owner. In november 2008, i purchased co-op Apartment in New Jersey. I'm not sure who drew up these weird rules of what the ''ideal'' place to raise a child is. I'm not saying every city is ideal, but not every suburban or rural place is exactly either. One thing I always hear over and over is safety. Unless someone believes what they here in Hollywood, they'd realize cities like NYC, Boston & Chicago are very safe. Someone doesn't have to be a cop to know how to read crime indexes rather than newspaper blogs and let in sink. New York City is ranked the 136th safest city with populations of at least 100,000, tied with Boise, Idaho. I hope that's not ''intimidating.'' Brooklyn is tied with Hartford, CT, a college town. You could see the links and sources provide on Wikipedia. You may not own real estate (you may rent) or own an apartment with little property (therefore, low property taxes). You'd be able to afford private school (if that's your preference). You wouldn't need to own a car (helping save on not paying car insurance, car loans, wear and tear, gas, ect.). If you were from a suburb in Northern Jersey, if you opt'ed for the city instead you wouldn't have to pay ridiculous property taxes. You'd have a cheap commute to work. Even if people have less children because of expense, there'd be so many children living in such a close proximity that they'd meet other kid's as opposed to setting up ''play dates'' on a cul-de-sac. There's pros and cons to everything. Besides space though (if that's what someone desires - although it'd be more costly), everything seems to be leaning into the favor of the city. They'd be able to get around as a teenager without you having to chauffeur around everywhere. Wouldn't it be more ideal to be able to see lots of different cultures first hand? Now just people from all over the world, but all over your country too. 85 percent of people don't look the same. Not everyone comes from the same background. You mention ''creeps.'' On a suburban cul-de-sac, when no one's outside, if a couple of kid's are out on the street and a guy in an Ice Cream Truck asks them if they want to jump on there's a chance no one will see. With people around everywhere - not to mention a higher cop-to-person ratio, it'd seem like those ''creeps'' would have a much less likely chance of getting away with it. Terrorist attacks is a legitimate concern, but if you were to live in a suburb and commute to New York City, like so many do, the parents would be equally as vulnerable. If it were biological, everyone in the city and nearby suburbs would be screwed. Ironically (and I say that due to higher stress level and pollution), New Yorkers (or New York residents) average a life expectancy of 2 years above the average of the country. People have closer and quicker access to hospitals, doctor offices, clinics, ect. There's also a larger variety of foods at different stores within walking distance of where you live You'd also be more custom to walking everywhere which provides exercise. You wouldn't be lonely and would have a better chance of meeting someone too.  more

I have a somewhat psycho ex-wife and 2 kids with her. I have spent the better part of 5 years of hell, in and out of courtrooms, alleged criminal behavrior (arrests and all that). I am just now getting out of debt and may actually have a few pennies to rub together. I am 42 and make decent money. Anything that is titled or taxed (vehicle or real estate) or is an "account" (CDs, savings, checking, retirement accounts) is also something that a lawyer can get his hooks into. All they have to know is that it exists. So I am resigning myself to not seeing a lot of growth until she dies of her various diseases. Yeah, I can hold green cash, but I am very unsure of that losing a lot of value over the next 5-10 years because of inflation. I am down to buying Euros or maybe stockpiling some easily traded commodity, like oil, which won't spoil forever. I don't really want to buy precious metals, since you can't eat those if the world goes to s****. I have access to very large acreages to store stuff (large rancher in KS). Call me paranoid, but I've seen the absolute worst of people and lawyers recently. Thanks in advance for your ideas.  more

I purchased a repo home in December last year with cash while going thru some marital issues. The home needed to be pretty much completely overhauled. In March, I moved in full-time. I thought it was a well written letter and I support a lot of the points this person made in it. I'm just wanting to know what you guys think about it. Ok so my situation is crazy. I am a first time home buyer, and I found this house on this website from a couple of investors and they are selling the place for $185,000.00 but for investors $167,000.00 I will be on TDY for 6 months starting september to another state and I want to get this house and rent it out for the time being that I will be away. Now the house already has tenants living there, and I told the investor that I want to get the house but have the tenants remain there till I get back from TDY. i wanted to buy the investment price vs the selling price...being that its cheaper..I am so confused as to what to do. I called the listing agent of a house for sale, he wasn't available, but they said another agent can show it. I said I wanted to deal with the listing agent. They told me he wasn't available today. So a woman called me back (another real estate agent from that office) and made an appointment to show the house. Then she starts telling me that she is figuring out what the mortgage would be for me, getting an estimate on the insurance and adding the taxes in there so I know what I was dealing with as far as a monthly payment goes. Did she just weasel her way into the title of the buying agent (or whatever its called when the buyers are also represented by an agent)? How are taxes/profit calculated on selling real estate with owner financing. I buy a $5000 property. Then I sell it for a sales price of $7000 and let the buyer make monthly payments of $100 at 10% per year. So the $100 per month is not all profit. How are taxes paid or profit calculated on this. It will take more than one tax year to pay this off? What if the buyer quits paying after 1 year and looses the money paid? Then all those payments are taxable profit because I still have the property?  more

Neighbors of 7 y rs seem to have abandoned the property. Yard isn't mowed, kids are all gone and and someone stops over at the house to check on it. You know, it just has an empty feel to it.
